Terms and conditions

All interested persons must sign a contract (.word) to provide the rigg and animation service. Contact me if you are interested.

CLAUSULESOn the one hand, it will be known as: Aleluye "the Rigger".
On the other hand, it will be known as: (You), of legal age and acting in his own name, as "the Customer".
EXPOSE:I. The Customer is interested in the services of rigging and animation of a 2D model that will later be used as an avatar or virtual character that simulates the movements of the person in real time through facial recognition via webcam.II. The Rigger has knowledge with the use of Live2D software for the elaboration of the rigg and animation of facial expressions in 2D models.III. Both parties agree that they should work as a team to prepare the rigg and animation of the 2D model, providing the necessary information for its optimization. They agree to recognize this document as valid for legal monitoring of the contract.FIRST – OBJECT
This contract clarifies that the Customer entrusts the Rigger with the animation of a 2D model that will be made in accordance with the specifications and instructions given by the Customer through the Request Form.
SECOND – PROVISION OF SERVICES
To carry out the service, both parties must adjust to the following work model based on a period of 2 to 8 weeks:
Material review:
● The Customer must ensure that the 2D model is correctly separated and finalized for its correct rigging and animation. In case any component or layer is missing, the Customer must contact their provider to correct the details or the cost of the extra addition to the model can be negotiated with the Rigger.
● In case the Rigger need to modify the PSD file, permission from the provider will be required for proper manipulation.
● The PSD file containing the 2D model cannot be filtered by the Rigger. In case of doing so, the Customer may take legal action against the Rigger.
References and ideas before starting:
● The Customer will provide all possible graphic references and guides on the Request Form, giving notes and ideas for rigging the 2D model.
● The Customer will not have upload limits to add references and ideas to the board or chat.
● Once the Customer has provided the necessary graphic references, the Rigger must indicate those elements that are most convenient for The Customer in his final product.
Rigg and animation proposals before starting:
● The Rigger will use a work model limited by the contracted Service.
● The Rigger can submit proposals while the Client considers and decides on other elements of their project that have not yet been worked on.
● The Client can request proposed modifications. The Rigger must announce the availability in which these changes will be made in the WIP and animation proposals.
Acceptance of proposals before starting:
● The Customer must communicate to the Rigger the choice of proposals that are convenient for their project.
● The acceptance of the proposals may be gradual while other elements of the project are being discussed.
Work in progress:
● Once the information is collected, the Rigger will be able to rig and animate the 2D model, adapting to the proposals.
● The Customer may request minor modifications to the already animated parts.
● The Customer will not be able to request that the elements already worked on be modified if they has completely different ideas from the ones he has provided.
● The project can take between 2 to 8 weeks to finish, Keep in mind that orders are made in order of quota.
● Once the project is finished, the Customer will receive a Link Drive that will contain the rigged, animated and configured 2D model to be used in Vtube Studio.
● The editable file for Live2D will not be given.
● Extra charges will be added if the Customer requests the editable file.
● Any changes or additions after the completion of the project may be requested separately in the Rigger's services.
FOURTH – PRICES AND REMUNERATION
The services to be offered by the Rigger must be adapted to the prices according to the quote provided by the Rigger depending on the project requested by the Customer.
The payment is made through the Vgen platform. The fee is confidential and can be reviewed and updated by the Rigger depending on the situations that arise to carry out the project.The client must pay 10% of the total amount to secure their spot on the waitlist after the invoice is created. If payment is not confirmed within 5 days of the invoice creation, their spot cannot be secured.The Customer can discuss with the Rigger the number of partial payments in which they wish to settle the service. They will have a maximum of 5 partial payments to pay the total amount.To start the production of the project, the Customer will be asked to pay at least one of the previously discussed partial payments; otherwise, the project will not continue. The Client may pay the remaining partial payments within the timeframe they prefer.In cases of priority commissions:
● The Customer will be able to pay an extra amount if they require their project to have higher priority. The Customer can request this in the Request Form.
● Prioritizing the project over others on the waiting list will require an extra 50% extra of the total amount. The project will be completed within the usual delivery time of 2 to 8 weeks.
● Rush the delivery in one week will require an extra 50% extra of the total amount. The position on the waitilist will still be the same over other projects.
Prioritizing the project entirely over others within a week will require 100% extra of the total amount.
FIFTH - REFUNDSIn cases of refunds:
● The Rigger will refund 100% in case ther are not able to start the project. The Rigger will make clear the reasons why the refund will be made.
● Once the project production starts, no refunds will be issued.
●If the Rigger exceeds the delivery date for the completion of the project, a partial refund may be discussed privately or with the assistance of Vgen moderation.
Considerations:
Each Customer will get a slot on the waitlist depending on when they have paid.The production of the project will begin once the Rigger communicates that they are ready for that work.
SIXTH – OBLIGATIONS AND SUGGESTIONS OF THE PARTIESDuring the development of the project, the Customer must:
● Collaborate and provide the necessary information to carry out the project.
● Facilitate the information through the means suggested by the Rigger.
● Keep confidentiality and not leak any material made by the Rigger without their authorization.
● May not use or claim as their own any material provided by the Rigger.
● Request reports and samples of all project progress at all times for your safety.
In parallel, the Rigger must:
● Inform the Customer in case there are restrictions or copyright infringements that prevent the development of their project.
● Suggest proposals according to the Client's specifications at all times.
● Provide the reports and advances requested by the Customer.
● Keep confidentiality about the project during the realization and completion of the project until the Customer decides to publicly communicate they project.
● Send visual material of the progress that the Customer wishes to request.
● Request authorization from the Customer to show project progress.
SEVENTH – INTELLECTUAL PROPERTY
The Rigger will own the intellectual property of all products made during the development of the project related to this contract.
The Rigger exclusively assigns to the Customer the rights of exploitation and commercial use, but not the intellectual property.Both parties are prohibited from selling and reselling any product resulting from the development of this project, as well as the final file that the Client will receive.Once the project is finished, the Client must credit the Rigger, according to their criteria, in all requested media.The Rigger can use the final product in their portfolio to promote their work once the Client has publicly communicated the project. The client and their social media will be mentioned in the artist's portfolio.EIGHTH – CONFIDENTIALITY AND PRIVACY
Everything documented in this contract will be confidential. Both parties must avoid leaking information related to this contract and the project to prevent damage to intellectual property and identities.
Once this section has been read, both parties accept the terms and conditions that entail the execution of the project.
